A Florida federal judge has blocked Democrat President Joe Bidenās administration from releasing illegal migrants into the United States without being issued with notices to appear in court.
The temporary restraining order was issued on Thursday night by District Judge T. Kent Wetherell II.
Florida Attorney General Ashley Moody sued the Biden administration on Thursday.
Judge Wetherell said in his ruling:
Florida has a substantial likelihood of success because the challenged policy appears to be materially indistinguishable from the Parole+ATD policy vacated in Florida ā both in its purpose (reducing overcrowding at border patrol facilities) and manner of operation (releasing aliens into the country without first issuing a charging document placing them in immigration proceedings and simply directing the aliens to report to ICE within a specified period for further processing).
Wetherell added that crisis at the border is a āproblem that is largely one of [the administrationās] own making through the adoption an implementation of policies that have encouraged the so-called āirregular migrationā that has become fairly regular over the past 2 years.ā
Moody said:
āWe took swift action to protect the American people from Bidenās unlawful plan to release thousands of illegal immigrants when Title 42 lifts in an hour.
āI am grateful for the quick decision by the federal judge.ā
Customs and Border Protection (CBP) responded to the news with a statement:
āCBP will comply with the court order and is assessing next steps.
āThis is a harmful ruling that will result in unsafe overcrowding at CBP facilities and undercut our ability to efficiently process and remove migrants, and risks creating dangerous conditions for border patrol agents and migrants.ā
